Medical Defense
The firmís prime emphasis is in the area of defending medical malpractice, hospital liability and medically intense product liability and toxic tort lawsuits.  The firm, because of its substantive trial experience, represents practically all of the malpractice insurance companies for the vast majority of the physicians in Kentucky, Indiana and Ohio.  The Firm represents the physicians of two of the malpractice insurance companies of Florida.

To assist the firmís lawyers in case preparation, the firm maintains an extensive medical library and database through Medline and makes liberal use of registered nurses who work as legal assistants.  Each attorney, however, is expected to know the medicine to a degree unequaled in the legal bar, so as to be verbally and tactically conversant with the health care provider and potential experts at the first visit.

The firm also maintains an extensive medical exhibit repository so as to keep illustrative costs to a minimum and yet arm the firmís lawyers with the appropriate teaching tools for quality presentation.

Long-Term Care
Due to the medical knowledge and experience of the firmís attorneys and nurses, Whonsetler & Johnson has also developed a significant emphasis in the defense of nursing homes and assisted living facilities.  In a three state area, Kentucky, Indiana and Ohio, Whonsetler & Johnson represents medical directors, administrators, nurses and health care facilities in sophisticated and complex litigation involving the full scope of issues such as abuse, patient care and fraud.

Civil Rights/Employment
The firmís attorneys have extensive experience in the defense of civil rights and employment related claims, having litigated cases involving allegations of excessive force, denial of medical treatment, unconstitutional jail conditions, malicious prosecution, abuse of process, wrongful termination and discrimination in the workplace in both state and federal courts.  In addition, the firmís attorneys have provided seminars and group meetings to governmental personnel in an effort to educate these individuals on federal and state civil rights and employment law, thereby avoiding needless litigation.

Whonsetler & Johnson is listed in the Kentucky Trial Court Reporter as one of top Ten Most Prolific Trial Law Firms from 1998 to 2008 with a total of 71 trials in that time frame.  That total does not take into account the numerous trials Whonsetler & Johnson has tried in Ohio and Indiana.
